ThriftHub – Picker Terms & Conditions

Purpose of These Terms

These Terms are designed to protect both you, the Picker, and ThriftHub. By clearly outlining responsibilities, payout standards, and legal protections, we aim to ensure a safe, transparent, and rewarding experience for everyone using the Platform.

1. Independent Contractor Status

You are an independent contractor, not an employee, agent, franchisee, or partner of ThriftHub. You will receive a Form 1099 for tax purposes in accordance with U.S. tax law. You are solely responsible for all taxes, insurance, permits, and licenses related to your activity.

2. No Employer-Employee Relationship

This Agreement does not create an employment relationship. You are not entitled to any benefits (including health insurance, workers' compensation, or unemployment insurance). You agree not to make any claim to the contrary.

3. Assumption of Risk

You voluntarily assume all risks related to your activities as a Picker, including but not limited to travel, transportation, injuries, theft, loss, or damage of property. ThriftHub bears no responsibility or liability for any harm, injury, loss, or damages incurred while you use the Platform.

4. Full Control and Autonomy

You have full discretion and control over when and where to operate, which products to pick, and how to conduct your activity. ThriftHub does not monitor, manage, or direct your activities in any operational sense.

5. Release of Liability

To the maximum extent permitted by law, you hereby fully and irrevocably waive, release, and discharge ThriftHub, its founders, affiliates, and employees from any and all liability, claims, demands, or damages of any kind, known or unknown, arising from your use of the Platform or your participation as a Picker.

6. Indemnification

You agree to defend, indemnify, and hold harmless ThriftHub from and against any claims, damages, losses, liabilities, or legal costs arising from your actions or omissions while using the Platform, any damage or loss related to products you pick, or any breach of these Terms.

7. Platform Provided 'As Is'

ThriftHub makes no guarantees regarding your ability to earn, product approval rates, or item resale outcomes. The Platform is provided on an 'as is' and 'as available' basis.

8. Payment Terms

Payments for approved items will be processed within 30 business days from the date the item physically arrives at a ThriftHub warehouse. ThriftHub reserves the right to delay, reduce, or withhold payment if the item is damaged, counterfeit, materially different from the description provided, fails quality or authenticity checks, is not aligned with ThriftHub's policies, or if there is evidence of fraud or misuse.

Rejected Items

If an item is denied because it does not match the description or condition reported by the Picker, the Picker may select one of the following options at the time of submission:

  • Donate the item to a nonprofit organization chosen by ThriftHub.
  • Discard the item, with no return or donation.
  • Return of the item to the Picker, at the Picker's sole expense.

If no selection is made by the Picker within 72 hours of notice, the item will be deemed abandoned, and ownership will automatically transfer to ThriftHub, which may donate, recycle, or handle the item at its sole discretion.

Tax Compliance

In accordance with U.S. tax law, ThriftHub is required to collect a completed IRS Form W-9 once your annual payouts reach $600. Pickers who do not submit a valid W-9 may not continue shipping or receiving payouts beyond this threshold.

Item acceptance on the Platform is dynamic and may vary at any time based on ThriftHub's supply and demand needs. Approval of an item in one box does not guarantee future acceptance of the same or similar item. Users must not purchase or accumulate bulk quantities of any product in anticipation of future approval, as only items approved in real time for a specific box are eligible for payout. Any unapproved or excess items shipped may be discarded without payment.

9. Prohibited, Restricted, and Fragile Items

Pickers agree not to scan, submit, or ship any item that is prohibited by law or by ThriftHub's carrier and resale partners. This includes, but is not limited to: firearms, ammunition, explosives, hazardous materials, alcohol, tobacco, drugs, perishable goods, live animals, lithium batteries, counterfeit or stolen goods, and any other unsafe or unfit items.

Fragile Items

Fragile items such as glass, ceramics, or other easily breakable goods may be accepted at ThriftHub's discretion. Pickers are solely responsible for safe packaging. If a fragile item arrives broken, ThriftHub will notify the Picker with clear photo documentation. No payment will be issued, and ThriftHub will handle the item from that point forward at its sole discretion.

10. Dispute Resolution & Governing Law

All disputes shall be resolved through final and binding arbitration under the laws of the State of Delaware, USA. You waive any right to a jury trial or to bring class actions.

11. Legal Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to be valid. The rest of the Terms will remain in full effect.

12. Geographic Eligibility

ThriftHub is currently available only to Pickers operating in the following U.S. states:

Activities conducted outside of these states are prohibited and may result in account termination and forfeiture of compensation.

13. Final Acknowledgment

By using ThriftHub, you acknowledge and accept these Terms in full, confirm that you are an independent contractor, and waive any right to assert that you are or were an employee of ThriftHub.

You further acknowledge that ThriftHub may amend or revise these Terms and Conditions as needed to reflect operational, legal, or policy changes. ThriftHub will provide notice of any material updates via email or in-app notification. Your continued use of the ThriftHub Platform after such notice constitutes your binding acceptance of the revised Terms.
